Royalty Schedule
This page describes the current royalty calculations, which are subject to change pursuant to the Program Terms:
Royalty Calculations from Microsoft Xbox Live Distribution
Each quarter, Microsoft (or its provider) will pay the person or entity who submits the track and consents to the Program Terms (the "Submitter") a royalty in an amount equal to 30% of the MS Points Remittance Rate multiplied by the greater of:
the actual number of MS Points received by Microsoft for each such unit of the Submitter's track sold during the applicable calendar quarter and
the number of MS Points in the lowest Price Tier.
A minimum balance of $150 is required before any payment is made. All payment is subject to the applicable terms, including the Program Terms.
"MS Points" means the proprietary form of trading value that Microsoft makes available to Xbox Live Users to redeem for goods or services.
"MS Points Remittance Rate" means a rate on which Microsoft will base its calculation of the royalty for tracks redeemed for MS Points, as determined by Microsoft and published in the Xbox 360 publisher guide.
Microsoft, as retailer, shall have sole discretion over the retail price charged to end users of the RBN service; provided, however, that
MTVN may provide Microsoft with suggested retail prices for tracks and
Each Submitter shall have the right to suggest the retail price for each song created by such Submitter from among certain agreed-upon Price Tiers
As of the Effective Date, the Price Tiers shall be (a) 80 MS Points, (b) 160 MS Points and (c) 240 MS Points.
Royalty Calculations from Sony PlayStation Network Distribution
Each quarter, the Submitter will earn a royalty in an amount equal to 30% of the net sales (e.g., the amount received and retained by Harmonix less any refunds, returns, taxes and charges) on the Sony Playstation NETWORK. A minimum balance of $150 is required before any payment is made. All payment is governed by and subject to the applicable terms, including the Program Terms.
